Preliminary Hearing Set in Deadly Forklift DUI Case
37 year old Daniel Castillo is charged with felony vehicular manslaughter and driving under the influence causing death in a crash that took place in the Santa Maria Valley last August.
Investigators say Castillo was driving a farm forklift southbound on Philbric Road north of East Betteravia Road when he tried to turn left into a farm field and struck an older model Honda Civic heading in the opposite direction.
The 18 year old male driver of the Honda and his 49 year old female passenger died at the scene.
Two other women in the Honda were seriously hurt.
"We've done enough investigation and we believe the evidence is going to show that he was not even negligent in his driving", says Castillo's defense Attorney Adrian Andrade.
Andrade says he plans to produce evidence at a preliminary hearing later this month that will show that Daniel Castillo was not negligent at the time of the crash.
"They've got to show that he was under the influence and we believe that they are not going to be able to show that", Andrade says, "this is a very serious case, so its going to be approached serious both the by the prosecution and by ourselves, i'm sure they are going to have a number of experts to testify to various issues and we will be defending those issues."
Daniel Castillo remains in Santa Barbara County jail.
A preliminary hearing in the case has been scheduled for January 23.
